These Terms of Service ("Terms") govern your use of the OtherSide mobile application, website, and related services (collectively referred to as the "Service").
The Service is operated by YouTurn, registered in India ("OtherSide", "we", "us", "our").
By accessing or using OtherSide, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.
These Terms should be read together with the OtherSide Privacy Policy and Community Guidelines, which together form the Platform Policies.
1. Eligibility
You must meet the following requirements to use OtherSide:
- You must be 18 years or older.
- You must be legally capable of entering a binding contract.
- You must not be prohibited from using online services under applicable law.
By using the Service, you represent and warrant that you meet these requirements. OtherSide does not knowingly allow minors to use the platform.
2. Account Registration
To access most features of the Service, you must create an account. You agree that:
- the information you provide is accurate and current
- you will maintain the confidentiality of your login credentials
- you are responsible for activity under your account
You may create a profile using a pseudonym or nickname. However, you must not impersonate another person or misrepresent your identity. OtherSide reserves the right to suspend or terminate accounts suspected of fraudulent activity.
3. Nature of the Service
OtherSide provides a platform designed to facilitate connections between users.
OtherSide does not guarantee:
- compatibility between users
- that any interaction will lead to a meeting or relationship
- the authenticity of user profiles
The Service is a communication platform only. OtherSide is not responsible for the behavior of users.
4. User Identity and Representations
Users are solely responsible for the accuracy of information they provide.
OtherSide does not verify:
- identity
- marital status
- relationship status
- personal background
- intentions of users
Profiles may use pseudonyms. You acknowledge that some users may provide inaccurate or incomplete information. You are responsible for exercising caution when interacting with other users.
5. User Conduct
You agree not to use the Service to:
- harass, threaten, or abuse other users
- promote illegal activities
- distribute spam or unsolicited advertising
- impersonate another individual
- post misleading or fraudulent information
- upload malicious software or viruses
- collect user data without permission
Content that violates laws or platform policies may be removed. OtherSide may suspend or terminate accounts involved in violations.
6. Prohibited Content
You may not post or share content that:
- is illegal
- promotes violence or hate
- exploits minors
- contains child sexual abuse material
- promotes prostitution or trafficking
- is defamatory or misleading
- violates intellectual property rights
- invades another person's privacy
OtherSide has a zero tolerance policy for child exploitation. Accounts involved in such activity will be reported to authorities.
7. User Content
"User Content" includes any content you post or share on the platform.
You retain ownership of your content. However, by posting content on OtherSide you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content for the purpose of operating the Service.
You are solely responsible for your User Content. OtherSide may remove content that violates these Terms.
8. Platform Moderation
OtherSide may review, moderate, or remove content to maintain platform safety. We may use:
- automated systems
- human moderators
- user reports
We reserve the right to remove content or suspend accounts that violate platform policies.
9. Discreet Platform Protections
OtherSide is designed to support discreet interactions. The platform may include features such as:
- screenshot blocking
- biometric or PIN access
- privacy-focused profile settings
However, no technological safeguard can completely prevent external capture of content. Users should exercise caution when sharing personal information.
10. Content Shared With Other Users
Content shared with other users may be saved or redistributed by those users. OtherSide cannot control how users handle shared information. Users acknowledge that information shared through the platform may not remain private.
11. Off-Platform Interactions
Users may choose to interact outside the platform. OtherSide does not control or monitor:
- communications outside the app
- meetings between users
- interactions on other platforms
Any interaction outside the platform is undertaken at the user's own risk.
12. Personal Consequences of Use
Participation in a dating platform may involve personal, social, or relationship consequences. OtherSide cannot guarantee confidentiality between users.
OtherSide is not responsible for:
- personal disputes
- reputational damage
- relationship conflicts
- emotional consequences arising from user interactions
13. Purchases and Payments
OtherSide may offer paid features such as:
- subscriptions
- premium features
- virtual items
- credits or tokens
Payments may be processed through:
- Apple App Store
- Google Play
- third-party payment gateways
All purchases are non-refundable except where required by law. Virtual items have no real-world monetary value and are non-transferable.
14. Intellectual Property
All intellectual property rights related to the platform belong to OtherSide or its licensors. This includes:
- software
- design
- logos
- trademarks
- branding
- interface elements
Users may not:
- copy or reproduce the platform
- reverse engineer the application
- create derivative services
15. Third-Party Services
The platform may include links or integrations with third-party services. OtherSide is not responsible for third-party services or their policies. Your use of third-party services is subject to their own terms.
16. Intermediary Status
OtherSide operates as an intermediary platform under the Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
We provide a platform for users to create and share content. We are not responsible for content posted by users. Users remain responsible for their own content and actions.
17. Termination and Suspension
OtherSide may suspend or terminate accounts that:
- violate these Terms
- engage in illegal activity
- pose a safety risk
- abuse the platform
Users may terminate their account at any time. Termination may result in deletion of account data.
18. Disclaimer of Warranties
The Service is provided "as is" and "as available."
OtherSide does not guarantee:
- uninterrupted service
- error-free operation
- compatibility with all devices
- successful matches or outcomes
19. Limitation of Liability
To the maximum extent permitted by law:
OtherSide shall not be liable for:
- indirect or consequential damages
- loss of profits or data
- personal disputes between users
- damages arising from user interactions
Our total liability shall not exceed the amount paid by you to the platform in the preceding month.
20. Indemnification
You agree to indemnify and hold harmless OtherSide and its employees, directors, and affiliates from claims arising from:
- your use of the Service
- your violation of these Terms
- your violation of applicable laws
- your User Content
21. Dispute Resolution
These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts located in Chennai, India.
22. Changes to the Terms
OtherSide may update these Terms periodically. Users will be notified of significant changes. Continued use of the Service indicates acceptance of the updated Terms.
